WICA (Work Injury Benefits)

WICA refers to the Work Injury Benefits Act 2007, the Kenyan law that compensates workers injured on the job. Employers must hold work-injury insurance so an injury on site is covered.

Construction is dangerous work. WICA — the Work Injury Benefits Act, often called WIBA — is the law that makes sure a fundi injured on site is compensated, and it places the duty to be insured on the employer.

What WICA covers

The Work Injury Benefits Act 2007 covers employees who are injured or killed in the course of their work. It provides for compensation for injury and death, and it obliges employers to take out work-injury insurance, known as WIBA cover, for the people they employ.

Why it matters on a construction site

Falls, struck-by accidents and trips are everyday risks on a Kenyan site. If an uninsured worker is hurt, the employer can face the full cost of compensation and a dispute. WIBA cover turns an unpredictable loss into a managed premium.

Claims and records

Injury claims run through the Directorate of Occupational Safety and Health Services and the Director of Dispute Resolution. A clear record of who was on site, when, and in what role strengthens any claim, and the muster roll is that record.

Frequently asked questions

Is WIBA the same as WICA?

WIBA stands for the Work Injury Benefits Act, and WICA is the name commonly used for the same law and its cover. Both point to the employer's duty to insure workers against on-site injury.

Must a contractor insure casual workers?

Employers are expected to hold work-injury cover for the employees they engage, and casual site labour is part of that. Confirm the scope of your policy with your insurer.

How does FundiPay relate to WICA?

FundiPay keeps the site attendance record of who was on site and when, which is the evidence an injury claim leans on. It does not sell insurance, but it keeps the record your WIBA cover depends on.
